ADA and CPUC Public Health Violations
For those refusing a Smart Meter for medical reasons these fees could be a form of discrimination under the Americans with Disabilities Act of 1990 and Public Utilities Code Section 453.
For the disabled and those with medical conditions (such as pacemakers) who choose an analog meter, you may request an accommodation. A doctor's support would be very helpful and possibly necessary.
Send your letter to the utility. If you are denied, you may file a formal complaint with the Dept. of Justice. Please see Electrosmog Prevention for more information and keep them in the loop if any of this is done to use as examples to file later with the CPUC, with your permission.

O.C. Customer Wins Small Claims Case And Appeal
Note: This decision was filed before the CPUC Opt Out ruling. It may or may not have any standing.
In 2012, Orange County resident, David Kyle sued SCE forcing the company to reinstall an analog meter.
Kyle won in Small Claims Court. SCE appealed and lost in Superior Court.
The won the right to have the smart meter removed. Below are the pertinent documents relating to the appeal judgement and the original case:

The original case is filled with citings on how the CPUC has jurisdiction over these matters of personal injury from a Smart Meter. Perhaps, it can be used when this gets defered to the FCC
Conclusion: SCE forced to reinstalled an analog meter by COURT ORDER. Further, it is rumored that this customer is not forced to pay the extortion Opt Out penalties.
